Workplace ADR

Collaborative techniques for disputes involving Army civilian employees, former employees, applicants, management, and labor organizations.

Workplace Disputes

Flexible Solutions for Workplace Problems

Workplace disputes include EEO complaints, employee grievances, adverse actions and appeals, and union-management disputes.

ADR techniques are particularly effective for problems common to workplace disputes: lack of communication, dysfunctional working relationships, and poor management practices.

Because ADR does not require a finding or admission of legal liability, it is more flexible than traditional adjudication in fashioning solutions.

EEO Complaints

ADR at Informal & Formal Stages

Federal agencies must make ADR available as an option for resolving EEO complaints at both the informal pre-complaint and formal complaint stages.

At the pre-complaint stage, parties may add non-EEO claims to resolve all contested issues at once and provide an economical global solution.

Mediation and facilitation treat the dispute as a problem for employee and management to solve together, reducing tension and refocusing attention on the mission.

Non-EEO Workplace Disputes

Labor-Management & Employee Relations

Labor-management relations

Collective-bargaining disputes include negotiated grievances, unfair-labor-practice allegations, negotiability issues, and bargaining impasses.

Management-employee relations

These disputes include appealable adverse personnel actions, administrative grievances by non-represented employees, and other workplace conflicts.

Local options

Parties may use joint review teams, mediation steps in negotiated grievance procedures, or peer-review panels before disputes reach outside tribunals.
