Requesting Services from The Army Roster of Neutrals

The Roster is composed of Army employees who offer their services as neutrals to Army organizations on a collateral duty basis.

Mediation services through the Army Roster of Neutrals are provided free of charge to Army organizations. The Neutrals are located throughout the world. The Army ADR Program will coordinate with Army organizations to assign an appropriate neutral from the roster. Two mediators are assigned to each matter, and they will utilize the co-mediation model.

Neutrals on the roster have received extensive training and have varied backgrounds. The majority of the Neutrals on the roster are trained in facilitative mediation.

Requesting Services from the Army Roster of Neutrals

To request mediation services from the Army Roster, organizations must provide:

  • The Agreement to Mediate in Good Faith signed by all parties involved in mediation session
  • Suggested agreed upon date(s) - at least 2 weeks out from date of this request for mediator - DO NOT CHANGE THE DATE REQUESTED without prior approval.
  • Choice of MS Teams or Telephonic
  • Organizations requesting in-person mediations are responsible to pay TDY and coordinate with roster manager at least 3 weeks out from date of request for mediator
  • Parties and Subject Matter Expert contact information
  • Organization Negotiated Settlement Agreement Template at least a week before the mediation

Before you schedule mediation double check with participants the following:

  • Investigation
    • Check with participants to see if there are any investigations currently happening. Explain if the investigation timeline is different or apart of the current mediation.
    • Pending or waiting for results - will it be within timeline of current process? Should mediation be scheduled after an investigation is complete?
  • Signature authority (SA) Role
    • Ensure you have the correct signature authority – i.e., an agency official with the authority to bind the government in resolving the dispute.
    • Have SA to prepare and get an understanding of the issues before the mediation.
    • Talk to Legal and LMER about possible solutions to address issues and think outside the box – don't assume all parties will agree (complainant also needs to do this and think about possible solutions).
    • Come with an open mind to hear, address, and consider solutions for new issues or ideas provided by all parties.
  • Attorney Participating
    • Explain to clients the stage of the process and the role of attorneys.
    • If complainant doesn't have attorney does agency rep need to be in attendance.

If information provided in requests for mediation services is personal, proprietary, or otherwise sensitive, such information will be protected in accordance with The Privacy Act
