About the Installations, Environment & Civil Works Practice Group

Bio for Craig R. Schmauder, Deputy General Counsel for IE&CW

The Installations, Environment & Civil Works (IE&CW) practice group is responsible for providing legal advice and guidance to the Secretary of the Army and Secretariat officials concerning Army lands, facilities, and civil works projects. Major practice areas within the IE&CW portfolio include environmental law, wetlands protection, civil works, cultural and natural resource preservation, and the Army National Cemeteries Program, including Arlington National Cemetery.


Installations

The Deputy General Counsel and his staff provide legal advice to assist the Secretary of the Army and Secretariat officials with the oversight of the Army’s many bases, camps, forts, depots, ranges, training grounds, proving grounds, and other installations. Most of IE&CW’s installation portfolio relates to Army land and natural resource management and disposal, military construction, housing, and base realignment and closure. Notable initiatives include:

Housing Privatization

Providing legal advice on structuring military housing privatization transactions through use of the Military Housing Privatization Initiative authorities. Advising the Secretariat on the legal rights and obligations of the Army regarding the operation of privatized housing consistent with transactional documents and applicable law.

Enhanced Use Leasing

Providing legal advice on structuring leases of Army-accountable property executed under 10 U.S.C. § 2667. Advising the Secretariat regarding lease terms that facilitate obtaining fair market value consideration from lessees in the form of statutorily-permitted in-kind services.


Environment

The Deputy General Counsel and his staff advise the Secretary of the Army, the Assistant Secretary of the Army (Installations & Environment), the Assistant Secretary of the Army (Civil Works), and other Secretariat officials on environmental planning, environmental compliance and restoration, sustainability, natural and cultural resources, safety, and occupational health issues. Actions in these areas regularly require interaction and coordination with other federal agencies, state and local governments, and public citizens. Notable initiatives include:

Renewable Energy

Providing legal advice to the Office of Energy Initiatives (OEI), which supports renewable energy initiatives on Army installations. The OEI promotes the Army’s attainment of federal and Defense green house gas reduction and energy security objectives.


Civil Works

The Deputy General Counsel and his staff support the Assistant Secretary of the Army (Civil Works) and other Secretariat officials with legal issues relating to the U.S. Army Corps of Engineers' civil works and regulatory programs. IE&CW is responsible for addressing a wide variety of legal issues that are raised in connection with these programs. Work regularly involves developing Army legal interpretations of statutory authorities; developing, drafting, coordinating, and revising regulations; assisting the Department of Justice in litigation; and drafting, negotiating, and reviewing intergovernmental agreements relating to Army Civil Works projects worldwide. Notable initiatives include:

Navigation

Provide legal and policy advice on the detailed planning processes, authorization, funding, and implementation in support of navigation to ensure that water traffic can move safely, reliably, and efficiently with minimal impact on the environment. Assist in developing partnerships with local communities and stakeholders in cost sharing the construction and maintenance of these navigation channels and harbors. Negotiate agreements for the construction of deeper harbors to accommodate larger vessels.

Flood and Hurricane and Storm Damage Reduction

Provide legal and policy advice on the detailed planning process, authorization, funding, and implementation in support of the flood risk and emergency management activities, such as dams, levees and dikes, shoreline protection projects, emergency preparedness and response, and non-structural measures to reduce susceptibility to damage. Coordinate with other federal and local agencies and stakeholders in developing policy and the implementation of projects that protect lives and property in the event of floods and coastal storms, such as Hurricanes Katrina and Sandy.

Ecosystem Restoration

Provide legal and policy advice on water resources projects that protect and restore river habitats, restore floodplains, stabilize river banks, and improve water flow.

Army National Military Cemeteries

Providing legal advice to the Secretary of the Army regarding the program and budget for the Army National Military Cemeteries (ANMC) which consists of the Arlington National Cemetery (ANC) and the Soldiers' and Airmen's Home National Cemetery as well as oversight of 38 other Army cemeteries. Advising the Executive Director of ANMC regarding the interment and inurnment policies for the Army National Cemeteries and issues related to the other 38 Army cemteries. Advising the Superintendent of ANC regarding the administration, operation, and maintenance of ANC. Assisting in the ANC Advisory Group's review of requests for exceptions to interment and inurnment policy and advising the Secretary of the Army on his decision to grant or deny such requests. Advising the ANC Advisory Committee in their role as senior policy advisors to the Secretary of the Army with regard to the long term strategic direction of ANC.
